The Terms of Use page tells you how you may use WeatherOnline Online Services to access and view content that WeatherOnline makes available to you through these services. Examples of WeatherOnline's Online Services include WeatherOnline sites (weatheronline.co.uk, woeurope.eu, weatheronline.co.nz, wofrance.fr, woitalia.it, weatheronline.pl, woespana.es, havaturkiye.com, weatheronline.gr, woweather.com, weatheronline.cz, pogodaonline.com, woweer.nl, weatheronline.in, weatheronline.pt, weatheronline.de, ...), WeatherOnline Applications, WeatherOnline Widgets and WeatherOnline RSS Feeds.

Additional Terms of Use which vary or supplement these Terms of Use may apply to your access of some WeatherOnline Online Services ("Additional Terms"). The Additional Terms of Use apply to users of WeatherOnline Memberships and WeatherOnline Applications.

Please note: WeatherOnline may update these Terms from time to time so please review these pages regularly.

Information about us The WeatherOnline Online Services ("WO Services") are owned and operated by WeatherOnline Limited, a company registered in England and Wales with company number 4619915 and with its registered office at "Brookfield Court Selby Road, Garforth, Leeds, LS25 1NB, United Kingdom" (referred to as "WeatherOnline" or "WO").

Acceptance of Terms

1. By using WO Services you agree to be legally bound by these Terms, which take effect immediately on your first use of WO Services. If you do not agree to be legally bound by all the following Terms please do not access and/or use WO Services.

2. WO reserves the right to change these Terms at any time by posting changes online without notice to you. It is your responsibility to review these Terms regularly to ensure that you are aware of any changes made by WO. Your continued use of WO Services after changes are posted constitutes your acceptance of the changed Terms of Use.

Permitted Use

1. You may not copy, reproduce, republish, download, post, broadcast, transmit, use to generate Value Added Services or otherwise use WO Services' content in any way except for your own personal, non-commercial use. You also agree not to adapt, alter or create a derivative work from any of WO Services' content except for your own personal, non-commercial use.This applies to all content provided and specifically to content/products derived from radar data whereas WO is bound by contract to take legal measures in case of breach of the above conditions. Any other use of WO content requires the prior written permission of WO.

2. You agree to use WO Services only for lawful purposes, and in a way that does not infringe the rights of, restrict or inhibit anyone else's use of WO Services. Prohibited behaviour includes harassing or causing distress or inconvenience to any person, transmitting obscene or offensive content or disrupting the normal flow of dialogue within WO Services.

Monitoring

WO shall have the right to refuse to post or to remove any material, submitted to or posted on WO Services, at any time, without notice, if in WOs sole discretion the material is considered to be in violation of these Terms of Use or otherwise objectionable.

Disclaimers of Warranty and Limitation of Liability

WO aims to ensure that the content is accurate and consistent with its current scientific understanding. However, the science which underlies meteorological forecasts and climate projections is constantly evolving. Therefore any element of the content which involves a forecast or a prediction should not be relied upon as though it were a statement of fact. To the fullest extent permitted by applicable law, WO excludes all warranties or representations (express or implied) in respect of the content.

Your use of the content is entirely at your own risk. We make no warranty, representation or guarantee that the content is error free or fit for your intended use. You should carry out your own evaluation and verification exercise before choosing to rely upon any of the content in any way.

1. You expressly agree that use of WO Services is at your sole risk. Neither WO, its affiliates nor any of their respective employees, agents, third party content providers or licensors warrant that WO Services will be uninterrupted or error free, that defects will be corrected, or that WO or the server that makes it available are free of viruses or bugs. Nor do they make any warranty as to the results that may be obtained from use of WO Services, or as to the accuracy or reliability of any information, service or merchandise provided through WO Services.

2. WO content, including the information, names, images, pictures, logos and icons regarding or relating to WeatherOnline, its products and services (or to third party products and services), is provided "AS IS" and on an "IS AVAILABLE" basis without any representations or any kind of warranty made (whether express or implied by law), including the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.

3. WeatherOnline will not be liable for any damages, including indirect or consequential damages, or any damages arising from use or loss of use, data or profits, whether in contract, negligence or other tortious action, arising from or in connection with the use of WO.

Nothing in the Terms excludes or limits either the WO's or your liability for death or personal injury caused by negligence or for fraud.

Expenses, equipment and software

You are solely responsible for paying all expenses you may incur when you access or use WO Services or access or download WO content including your internet or data service provider charges and any excess charges to that provider if you have a limit on the amount of data you can download together with all costs of the equipment and software you need to connect to and use WO Services. Accessing and using some WO Services features to access, download, view or listen to WO content (especially video or audio) may lead to substantial bandwidth usage by you which can be expensive so you should be careful you do not exceed any 'bandwidth cap' on your account with your internet or data service provider. The WO is not responsible if your equipment or software is not compatible with any WO Service. WO content may be streamed or downloaded to your device from servers owned and operated by WO or (on behalf of the WO) by third-party content distribution networks.

Links

WO Services may contain links and advertisements to internet sites maintained by others. You acknowledge that these links are provided solely as a convenience to you and not as an endorsement by WO regarding the content of those other websites.
You acknowledge further that WO having no control over these other sites is not responsible or liable for the availability of such external sites and is not responsible or liable for any content on such sites.
WO points out expressly that the use of these other websites is at your own risk.
You further acknowledge and agree that WO shall not be responsible or liable, be it directly or indirectly, for any damage or loss caused by your use or in connection with your use of such other sites.

Intellectual Property

The names, images and logos identifying WeatherOnline or third parties and their products and services are subject to copyright, design rights and trade marks of the WeatherOnline and/or third parties. Nothing contained in these Terms shall be construed as conferring by implication, estoppel or otherwise any licence or right to use any trademark, patent, design right or copyright of the WeatherOnline, or any other third party.

Contributions to WO: where you are invited to submit any contribution to WO (including any text, photographs, graphics, video or audio) you agree, by submitting your contribution, to grant WO a perpetual, royalty-free, non-exclusive, sub-licenseable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, play, and exercise all copyright and publicity rights with respect to your contribution worldwide and/or to incorporate your contribution in other works in any media now known or later developed for the full term of any rights that may exist in your contribution, and in accordance with privacy restrictions set out in the WO's Privacy Policy. If you do not want to grant to WO the rights set out above, please do not submit your contribution to WO.

Further to this, by submitting your contribution to WO Services, you warrant that:
a) your contribution is your own original work and that you have the right to make it available to WO Services for all the purposes specified above;
b) your contribution is not defamatory and does not infringe any law.
c) you shall indemnify WO against all legal fees, damages and other expenses that may be incurred by WO as a result of your breach of the above warranty;
d) you shall waive any moral rights in your contribution for the purposes of its submission to and publication on WO and the purposes specified above.

Miscellaneous

If any part of the Terms is found to be illegal, invalid or otherwise unenforceable by a court or regulator, then, where required, that part shall be deleted from the Terms and the remaining parts of the Terms will continue to be enforceable.

Applicable Law/Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of England and Wales. In the event of any dispute that arises out of or in connection with these Terms of Use, you consent to the exclusive jurisdiction of the English Courts.
You also agree that any claim, case or cause of action against WO must be filed with a court within 1 (one) year after it arose, otherwise it shall be forever forfeited.
